The Sony Rewards Program (“Program”) is owned and operated by Sony’s Card Marketing and Services Company, a division of Sony Electronics Inc. (“Sony”), and is provided subject to the terms and conditions of this Agreement. The Program is void where prohibited by law.
Please read this Agreement carefully before accessing, registering or using the Program, www.Rewards.sony.com (the “Website”) or the Sony Rewards Mobile Application (the “Mobile App”). This Agreement governs your rights and responsibilities in connection with the Program, and applies to the Website, its web pages, the Mobile App, and all interactive features, applications, widgets, blogs, social networks and any other online or wireless offerings that post a link to this Agreement, whether accessed via computer, mobile device or any other manner or means.
Sony reserves the right, in its sole discretion, to make changes to this Agreement, and/or to discontinue, change or modify the Program, at any time, without notice and without liability. Changes to this Agreement will be effective when posted to www. rewards.sony.com/terms. You agree to review this Agreement periodically to become aware of any such changes. Your use of any part of the Program after Sony posts any changes to this Agreement will be considered your acceptance of those changes and will constitute your agreement to be bound thereby.
Your use of certain Program features, functionality, programs or services may be subject to additional or special terms and conditions, which may include specific restrictions on or instructions with respect to the use of certain Products (as defined below) and services offered through the Program. All such terms and conditions are incorporated into this Agreement. You also may be subject to additional terms and conditions that may apply when you obtain or use third- party content, third-party software or goods and services provided by or through Partners (as defined below) or other third parties.
i. Eligibility; Restrictions. Membership in, and use of, the Program and all of its aspects is limited to persons who are (i) at least 16 years of age, and (ii) permanent legal residents of one of the 50 states in the United States of America or the District of Columbia and are currently physically located and residing therein. For clarity, Membership in and use of the Program is not offered to and excludes Guam, Puerto Rico and all other U.S. and foreign territories and possessions.
a. Automated services, scripts or machines may not use the Program or become Members (as defined below). The Program is solely for a Member’s personal, noncommercial use. An individual may only have one Program account (each an “Account”), even if that individual has multiple e-mail addresses. Additionally, only one Account per e-mail address is allowed.
ii. When registering for the Program, you must provide Sony true, accurate, current and complete information (the “Registration Data”). You must also update your Registration Data as necessary to keep it accurate, current and complete. The email address you provide will be your Account name. You must also select a password when you register.
iii. By clicking submit on the Sony Rewards registration page, you are completing the registration process, being accepted into the Program and becoming a member of the Program (“Member” or “you”). Each individual may only have one Account. In the event that an individual has more than one Account, Sony shall have the right to close one or all of such individual’s Accounts, and in conjunction with such closure(s), accumulated points may be forfeited. By registering, you acknowledge and agree that Sony may use your Account name and password for all valid business purposes it deems appropriate, including, without limitation, to (a) access your Account and records, (b) update your Account profile information, and/or (c) assist you with redeeming Sony Reward Program points (“Points”).
cc. Sony Card and PlayStation Card Visa Credit Card Holders (collectively, “Cardholders”)
If you have a Sony Visa, Sony Visa Signature, PlayStation Visa, or PlayStation Visa Signature Credit Card Account issued by Comenity Bank (collectively, “Card”), Sony will try to automatically match the email address that you provided on your Card application with an Account email address so that your Card account is linked with your Account. If Sony is not able to automatically link your Card account to your Account, Sony will send you an email to the email address you provided on your Card application indicating that it was not possible to link your Card account to your Account. It is thereafter your responsibility to contact customer service at 877-718-SONY to link your Account to your Card account. In the event that you do not have a Sony Rewards Account when you apply for a Card, as indicated in the Card application, you will be enrolled in the Program when the Bank opens your Card, if you are eligible in accordance with Section (i) above (Eligibility; Restrictions).
This Agreement is separate and independent from your Sony Visa, Sony Visa Signature, PlayStation Visa, or PlayStation Signature Credit Card Account Agreement (your “Credit Card Account Agreement”), which governs the use of your Card. In the event of any conflict between this Agreement and your Credit Card Account Agreement, this Agreement will control in any matter relating to the Program.
d. Unauthorized Activity and Access. You are solely responsible for keeping your Account name (email address) and password confidential, from preventing unauthorized access to your Account and for all activities that occur on your Account, including all unauthorized or illegal activities. Sony is entitled to act on instructions received by it if a correct Account name and password is provided, and in such case Sony will not be liable for (i) any debits made to the applicable Account, or (ii) any other loss or damage arising from a Member’s failure to adequately safeguard his/her Account name and/or password. You agree to immediately notify Sony of any unauthorized use of your Account or any other breach of security related to the Program or the Website/Mobile App.
e. Use and Storage. You acknowledge that Sony may establish general practices and limits concerning use of the Program, including, without limitation, the maximum number of days that information, data, account history or other uploaded content will be retained by the Program, the maximum disk space that will be allotted on Sony’s (or its third party vendor’s) servers on your behalf. You acknowledge that Sony reserves the right to terminate any non-cardholder Members and closed cardholder Members who had no point earn or burn activity in a 24 month period and no Sony channel engagement (website visit, website login, mobile app use, SMS open, email open or email click, SMS click) in a 12 month period. Non-cardholder Members are defined as anyone who does not have an open Card. You further acknowledge that Sony reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice. You agree that Sony has no responsibility or liability for the deletion or failure to store any information, data and/or other communications or other content maintained or transmitted by or through the Program.
2. Sony Rewards Points
a. General. Members can earn Points by participating in various Program activities and Offers (as defined below). The number of Points awarded per activity or Offer is decided by Sony in its sole discretion, and may be different than the Point earning numbers indicated throughout this Section
2. Additionally, Sony may grant Points in ways that are not set forth in this Agreement to one or more Members and may attach different expiration dates to such Point grants, in its sole discretion. Points have no cash value, and may not be sold, transferred or bartered.
b. Points Summaries. Members may view (and should review on a periodic basis) the summary of their Points accumulation, redemption and expiration on the Website. You are solely responsible for ensuring that all Points that you earn are included in your Point balance and that your Points balance is correct. In the event that earned Points are not included in your Point balance, or Points are incorrectly deleted from your Points balance, you have one (1) year from the day on which either the Points were earned or the Points were incorrectly deleted from your Account to notify Sony in writing by going to www.rewards.sony.com/ contact.html. After such period, Sony will not add such Points into your Account.
c. Point Ownership & Transferability. You have no property interest in your Points or any similar reward Sony may offer under the Program. Membership in the Program, any Points earned and any other related membership benefits are not transferable, and you may not combine or merge your Points with the Points in any other Member’s Account. Points will expire as further explained below.
d. Earning Points. The earning of Points, whether through Offers (as defined below), Account linking, Card (as defined below) spend or any other manner, is always subject to complete Program terms and conditions at rewards.sony.com/terms.html. If your Points balance goes negative, you must first earn Points to bring your Points balance to zero before redeeming any points. The ability to earn Points through any manner, including those indicated below, represents a limited time offer that can be modified or discontinued by Sony at any time.
i. Earning Points through Sony and Partner Offers.
Sony, and its affiliates may send Members information and offers and promotions (each an “Offer”), via email, social networks, mobile communications (i.e. text messages, push notes), physical mail, or any other means. Activity by you in response to an Offer may, in some cases, provide you with the ability to earn Points, if you strictly comply with the terms of the applicable Offer. Not all Members will be eligible for certain Offers, and if you receive an Offer in error, Sony reserves the right to nullify Points erroneously credited to your Account. In the event of an error in the description of an Offer’s terms, Sony shall have the right to revise the description as necessary, and will not be responsible to any Member, including without limitation, to reward Points to such Member, for such error. Points earned in conjunction with an Offer may have expiration dates that are not the same as the Point expiration dates outlined in Section 2(f) (Expiration of Points) below.
In addition, Sony’s third-party merchants, partners, sponsors and clients (“Partners”) may send you offers or promotions (“Partner Offers”). Your participation in Partner Offers or correspondence with the Partners regarding Offers or products and services offered by the Partners, is solely between you and the applicable Partner. Sony does not operate, control or endorse any information, goods or services of any of its Partners in any way. Sony assumes no liability, obligation or responsibility for, and makes no warranty with respect to: (i) any part of any Partner Offer or the timeliness of delivery of Partner goods or services;
(ii) communication or correspondence between a Member and a Partner; (iii) security associated with credit card or other transactions initiated by a Member with a Partner; (iv) maintenance of privacy of any personal information given by any Member to any Partners; and (v) any loss or damage of any sort incurred as the result of any dealings with Partners, or as the result of the presence of such Partners on any Sony or Partner Website or via the Program.
All Offers and Partner Offers are void where prohibited by law.
ii. Earning Points through Account Linking. As part of the Program, you may tie your Account to an account that you have with an affiliate of Sony. Sony, in its sole discretion, may award Points to you for your tying of your Account with your account with a Sony affiliate. Additionally, tying of your account may be required in order to earn Points with a Sony affiliate.
iii. Earn additional points with PSN™ paid subscriptions. Double and triple points earning is available for certain qualified purchases of PlayStation®Plus, PlayStation™Now, and/or Spotify® available on PlayStation™Music (“PSN™ Services”) as indicated in this Section 2(d)(iii). Members that have linked their Account to their PlayStation Network (“PSN”) account will earn a total of 2 Points per dollar spent on all PlayStation™Store purchases if they are paid subscribers to two PSN™ services and 3 Points if they are paid subscribers to three PSN™ services, provided that no Points will be earned on taxes paid. To qualify for double or triple Points earning, the Member must have an Account that is linked to his/her PSN account. To become a Member go to rewards.sony.com/join. Members should allow up to 5 business days for bonus Points to post to their Account.
iv. Earning Points on a Sony and PlayStation Card. In order for you to earn Points with a Sony Card or a PlayStation Card, your Card must be in Good Standing. “Good Standing” means (1) your Card is open to new charges and not over your credit limit, (2) your Card is not more than 60 days past due or otherwise in default, (3) your Card is not flagged as lost, stolen, or fraudulent according to Comenity Bank’s (the “Bank”) records, (4) your Card is not in a hardship or workout program, and (5) you are not subject to a credit counseling arrangement relating to your Card.
For both Sony and PlayStation cardholders, earning Points on the Card is limited to earning Points for Net Eligible Purchases. Net Eligible Purchases are purchases of goods and services for personal, family and household purposes using your Card and the Card(s) of your authorized user(s), if any, minus any returns, refunds or credit adjustments, rounded to the nearest dollar. Transactions ending in .50 will be rounded to the nearest even dollar. As an example, $24.50 rounds to $24.00 while
$25.50 rounds to $26.00. Points are not earned on, and the term “Net Eligible Purchases” does not include: returns, refunds, credit adjustments, unauthorized or fraudulent charges, charges that violate the terms of your Credit Card Account Agreement, purchases made by or for a business or for a business purpose, balance transfers, cash advances or any other transaction treated like a cash advance, interest or fees.
v. A Member that holds a Sony Card in Good Standing will earn 5 points per $1.00 spent on Sony & PlayStation purchases, to the extent that such purchases have been confirmed, at authorized retailers as well as 5 points per $1.00 spent on Entertainment * (see Merchant Classification below). A Sony Card holder will also earn 2 points per $1 spent on Restaurants * (see Merchant Classification below) and 1 Point per $1.00 spent on all other card purchases that do not qualify for an accelerated bonus, when the Sony Card is used.
vi. Additionally, new cardholders receive 5,000 bonus Points ($50 value) to redeem after the first card purchase. New cardholders also receive a $50 statement credit after spending $500 or more within 60 days of account opening. If you have a Sony Card, for additional information, including authorized retailers visit https://www.sony.com/retailers. To complete purchase confirmation, download the Sony app at https://www.rewards.sony.com/app.html and fill out the bonus points form in the My Account section or contact the Sony Rewards Customer Service at 877-718-7669.
A Member that holds a PlayStation® Card in Good Standing will earn $75 in free game(s) when they activate and spend $500 on purchases outside of PlayStation and Sony with the PlayStation Card within 60 days of account opening. A PlayStation® Card holder will earn 5 points per $1.00 spent on Sony & PlayStation purchases, to the extent that such purchases have been confirmed, at authorized retailers. A PlayStation® Card holder will also earn 3 points for each $1.00 spent on cable or internet bill payments (bundled services, cellular services, and services through cellular companies may not qualify) and 2 points for each $1.00 spent at restaurants * (see Merchant Classification below) and 1 Point for each $1.00 spent on all other purchases on the PlayStation® Card. If you have a PlayStation® Card, for additional information, including authorized retailers visit https://www.sony.com/retailers. To complete purchase confirmation, download the Sony app at https://www.rewards.sony.com/app. html and fill out the bonus points form in the My Account section or contact the Sony Rewards Customer Service at 877-718-7669.
vii. *Merchant Classification
Each retailer, business or any other place where you can make a purchase using a Card (“Merchant”) is assigned a code that indicates the Merchant’s area of business. For example, gas stations or grocery stores are each generally assigned a specific merchant code. Neither Sony nor the Bank assign or have any control over merchant codes. Merchant codes are chosen and assigned by a third party, who may change the codes from time to time. When you make a purchase at a Merchant, the Bank is provided the code for the Merchant. If the merchant code matches a category that gives you additional Points, as indicated above, you will receive the additional Points for that purchase. Because neither Sony nor the Bank controls what code a Merchant is assigned, sometimes a purchase that you think fits a certain category may not earn additional Points.
viii. Points for Special Offers.
From time to time, Sony or the Bank may make special offers for you to earn additional Points for Net Eligible Purchases. These additional Points are called “Bonus Points.” The way to earn Bonus Points, and the Bonus Points that can be earned, may vary. Read each offer carefully, as there may be important conditions or limitations, such as blackout periods, Bonus Point limits, or exclusions. You may also have to register to qualify for the offer. Sony or the Bank may change or withdraw an offer at any time without notice. Any such change or withdrawal will not affect Bonus Points already earned. Your Net Eligible Purchase must be completed, and the transaction charged to your Card during the special offer period in order for you to earn the applicable Bonus Points. For mail orders, special order, online, and other purchases, please be aware that the Bank may not charge your Card until items purchased have shipped. During special offer periods, making a return in the same transaction as your purchase may result in earning fewer Points because Points are calculated off of your Net Eligible Purchase (in this case, your purchase minus return).
iv. Redeeming Points. This Agreement shall govern your redemption of Points for any item, digital code or merchandise offered for sale or licensing through the Program (each a “Product”), and your purchase of Points in connection with a redemption. A Member may redeem his/her accrued Points for anything listed on the Website/Mobile App or the Program’s print catalog, provided, that in order to redeem Points or otherwise take advantage of any redemption Offer, Sony may require that you have at least 500 Points in your Account prior you redeem. (You may purchase additional Points in the event that you do not have the required number of Points to take advantage of an Offer.) Points will immediately be put on hold upon placing an order and thereafter will be deducted from a Member’s Account upon shipment of the redeemed Product. Sony will only deliver redeemed Products to a valid mailing address located within the fifty (50) United States or the District of Columbia, provided that no deliveries will be made to an APO or P.O. Box.
e. In the event that a stated price for a product or the number of Points needed to redeem a Product is actually more than what is stated in the applicable Offer, Sony may, in its sole discretion, permit the redemption of the Product based on the incorrect price, or upon notice to you, cancel the Product order.
f. Expiration of Points. Unless otherwise indicated by Sony when points are granted or in the information connected to a specific earning Offer, as long as you remain an Active Member (as defined below), Points that you earn will expire on the date that is five
(5) years from the last day of the month in which your Points were earned. If you are not an Active Member during any eighteen (18) month period, all Points in your Account will expire at the end of such eighteen (18) month period. An “Active Member” is a Member that has Point earning or redeeming activity, which includes both Points earned for spend on a Card and Points earned or redeemed through the Program. In the event that Points expire or are forfeited, they will do so on the applicable date at 11:59 pm Pacific Time.
3. Sony Rewards Purchase Credit Option
with your Card, you can use the Purchase Credit Option through the Mobile App. To use the Purchase Credit Option, within sixty
(60) days of purchasing a new Sony product, go to the My Account section of the Mobile App, upload a picture of your sales receipt and complete the purchase information section. Upon successful upload and completion of the information section, Sony will: (i) calculate the number of Points required to purchase the applicable Sony product, at a rate of 115 Points per $1 of retail price (excluding tax); (ii) deduct the number of Points required to purchase the applicable Sony product from the Card Member’s Account balance; and (iii) credit the dollar amount of the purchase, or any portion thereof, to the Member’s Card account. The Member is not required to have the total number of Points required to cover the entire purchase. Sony will deduct as many Points as available for use towards any partial redemption of the applicable Sony product, up to the amount charged on the Card for such product. To take advantage of the Purchase Credit Option, your Account must be open when Sony processes the Purchase Credit. Sony may change or remove the Purchase Credit Option at any time without prior notice.
4. Products Purchased through the Program.
a. Product Offerings. Sony, in its sole discretion, may revise, limit or discontinue the Products offered through the Program at any time. Quantities of Products are always subject to availability. In the event of a shortage of a Product, Sony may allocate the sale of such Product(s) in its sole discretion. Sony is not responsible for pricing, photographic, typographic or system errors.
b. Warranty. Sony makes no representation or warranty with respect to Products obtained through the Program. Any warranty on a Product purchase through the Program will be limited to the warranty card, if any, included with the Product(s).
c. Shipment Contract. Every Product redeemed/purchased through the Program is redeemed/purchased pursuant to a shipment contract. This means that the risk of loss and title for such Product passes to the Member upon Sony’s delivery of such Product to the delivery carrier. In the event that a Product is lost prior to receipt by the Member, the Member shall immediately call Sony at 1-888-715-SONY (7669), between the hours of 10:00 am to 10:00pm ET, M-F and Saturday 10:00am to 8:00pm ET so that Sony can file a timely claim with the shipping carrier. If a Product arrives at the Member’s designated destination damaged or is defective, the applicable Member must contact Sony within fourteen (14) days of the date the Product was shipped by Sony and follow the directions in the “Product Returns and Exchanges” below.
d. Digital Codes and Gift Cards. Sony is not responsible for digital codes, and gift cards that are lost, stolen or not received unless such digital codes and gift cards are not shipped to the address (email or physical) entered by the Member during the redemption/purchase process. Digital Codes and gift cards may not be cancelled, returned, exchanged or replaced.
5. Product Returns and Exchanges
All redemptions/purchases of Sony Products from Sony through the Program are final. Once an order has been placed, Sony cannot cancel it. Except as explicitly indicated in this Agreement, you may not return or exchange any Sony Product purchased through the Program under any circumstances. As indicated above, if you receive a defective or damaged Product, you must contact Sony within fourteen (14) days of receipt of the Product. To report a defective or damaged item within such fourteen (14) daytime period, you must contact Sony Rewards at 1-888-715-SONY (7669), between the hours of 10:00 am to 10:00pm ET, M-F and Saturday 10:00am to 8:00pm ET. If a Product is returned without adherence to this policy, Sony reserves the right to (i) refuse to accept the Product or to restore Points and/or cash, and/or (ii) charge a restocking fee. After an authorized return has been received by Sony, Sony will immediately reship a replacement. Sony will only reimburse a Member for a defective or damaged Product if the exact model is not available.
Products Purchased through Partners. The return of any Products redeemed/purchased from a Partner shall be controlled by the applicable Partner’s return policy. You will need to look at such return policies and contact the applicable Partner if you desire to return a product redeemed/purchased from a Partner for any reason.
6. Intellectual Property Rights and Obligations.
a. Ownership of Information and Content by Sony and its Affiliates. All information and content on the Website/Mobile App, or contained in Program Materials (e.g. contained in Offers or electronic mail communications) which shall include, without limitation, all text, software, scripts, graphics, pictures, sounds, photographs, music, videos, interactive features and the like (“Creative”) and the trademarks, logos and service marks contained on the Website/Mobile App or in Program Materials (“Marks,” and collectively, with the Creative, the “Content”) is owned (or licensed) by Sony and its affiliates and is subject to and protected by copyright and other intellectual property laws. Sony reserves all rights with respect to such Content. Content is provided to you “AS IS” for personal use and Members may not, and shall not allow any third party to, use any Content or copy, modify, reproduce, republish, post, transmit, sell, license, create derivative works from, reverse engineer, reverse assemble, distribute or use any Content in any way without Sony’s prior written permission, and in such case, only in accordance with such written permission. In the event that you download or print a copy of any Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the Website/Mobile App or features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Website/Mobile App, the Program or the Content therein. You may not to access the Program by any means other than through the interface that is provided by Sony for such use.
b. Member Submissions. Sony respects the intellectual property of others, and we ask you to do the same. You therefore agree that any content (e.g., postings to social media websites or submission of contest entries), including without limitation, videos, text, pictures, photos, notes, drawings and graphics that you post to the Website/Mobile App or provide to Sony to use in connection with any other aspect of the Program (“Member Submissions”) does not and will not violate any law or infringe the rights of any third party, including, without limitation, any intellectual property rights, publicity rights, or rights of privacy. It is important that you understand that you are in the best position to know if your Member Submission is legally permitted. Sony may, in its sole discretion, disable and/or terminate the accounts of Members that it believes are repeat infringers of the above. If you believe your work has been copied in a way that violates your intellectual property rights, please provide Sony with the following information:
• the physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or other intellectual
property right that has been infringed;
• identification of the copyrighted work(s) that you claim has been infringed;
• a description of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed;
• information reasonably sufficient to permit the service provider to contact you, the complaining party (e.g., the address, telephone
number, or email address);
• a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the
copyright owner, its agent or the law; and
• a statement by you, made under penalty of perjury, that information in your notice is accurate and that you are the copyright or
other intellectual property owner or authorized to act on behalf of the copyright or other intellectual property owner.
Notice of claims of copyright or other intellectual property infringement shall be made to Sony’s Copyright Manager at 115 W. Century Rd., Suite 250, Paramus, NJ 07652, email: CopyrightManager@sony.com. phone: 201-930-6161. You acknowledge that if you fail to comply with the requirements of this Section 6(b), your notice may not be valid.
c. Protection and Ownership of Member Submissions. Moreover, Sony does not guarantee any protection of Member Submissions against use by third parties. You agree that except where prohibited by law, all Member Submissions shall become the property of Sony and shall be controlled by the ownership rights set forth in this Agreement. In the event that ownership cannot be transferred to Sony by the foregoing sentence, you hereby grant Sony a worldwide, non- exclusive, royalty-free, fully paid-up, perpetual, sublicenseable and transferable license to use, reproduce, distribute, create derivative works of, translate, publish, publicly display, and publicly perform the Member Submissions in any media formats and through any media channels.
7. Termination of the Card Issuing Bank. In the event that the Card program is terminated with the then-existing credit card bank issuer and such issuing bank is no longer affiliated with the Program, Card accounts, at Sony’s sole discretion, may have a grace period during which they will continue to have the privileges outlined herein for Card accounts. Such grace period will be determined and announced prior to such termination. After such grace period, Card accounts associated with the terminated credit card bank issuer will have the benefits outlined herein for Accounts non-cardholders.
8. Member Conduct
a. You agree not to use the Program, the Website/Mobile App to:
(i) Distribute, disseminate, post, or publish any information or material that degrades, embarrasses, harasses, humiliates, intimidates, or threatens any individual or group of individuals, is indecent, infringing, obscene or unlawful, or is confidential or protected proprietary data;
(ii) defame, threaten, stalk, harass or harm another individual, or otherwise violate others’ legal rights;
(iii) impersonate any person, or otherwise misrepresent your identity;
(iv) interfere with or disrupt the systems, servers or networks associated with or connected to the Program, the Website/Mobile App,
or disobey any requirements, procedures, policies or regulations of such networks;
(v) violate the terms and conditions and operating rules of the Program or interfere with another Member’s use of the Program;
(vi) attempt to gain unauthorized access to the Program, or to other Accounts;
(vii) transmit any file that contains viruses, worms, Trojan horses, or any other contaminating or destructive features, could damage another’s computer, or could violate the intellectual property, privacy or publicity rights of others;
(viii) use the Program to conduct any activity or solicit the performance of any illegal activity or other activity that infringes the rights of others;
(ix) engage in any commercial purpose on the site, including reselling or otherwise generating income by providing access to the Program, the Website or the Mobile App to others; or
(x) engage in any other conduct that is, or that Sony deems to be, in conflict with this Agreement or the intent of the Program.
b. You agree not to use any language in connection with the Program, on the Website/Mobile App or during calls to customer service that is offensive or obscene, as Sony deems in its sole judgment.
9. Termination; Suspension
a. Termination. Notwithstanding any other provision in this Agreement, you agree that Sony has the right to terminate or suspend this Agreement, and/or our Account at any time, in its sole discretion and without limiting other remedies, with or without prior notice, for any reason, including, without limitation, violation of this Agreement, or actions which are inconsistent with the letter or spirit of this Agreement or the Program.
b. Effect of Termination. In the event that Sony terminates your Account, your right to use the Program ceases immediately, and Sony shall have the right to immediately deactivate or delete your Account and all reward related information and files, and/ or bar any further access by you to such files or the Program, and if the Member does not have a Card registered with Sony he/ she shall forfeit any unredeemed Points. You agree that Sony shall not be liable to you for any termination of your Account or your access to the Program. Termination of your Account and/or participation in the Program will not cancel your Card.
c. Survival. The provisions of Sections 4 through 15 shall survive any termination of this Agreement.
10. Modifications to Terms & Conditions and Recourse
(ii) your ability to earn and redeem Points, and the number of Points that you can earn through specific activities or Offers; and
(iii) your ability to access certain support services.
Sony shall not be liable to any third party, including any Member, for any Change. Any Change that adds new or additional features of the Program shall be subject to this Agreement.
b. If you object to this Agreement or any Changes or at any time become dissatisfied with the Program, do not use or access (or continue to access) the Website/Mobile App or Program. Your sole recourse is to stop using the Program. Your continued use of the Program after notification of any Change(s) constitutes conclusive evidence of your acknowledgement of the Change and your agreement to be bound by such Change(s). Sony is not responsible for any automatic filtering you or your network provider may apply to email notifications Sony sends to the email address you provide to us.
11. Hyperlinking. The Website/Mobile App may provide a link to other websites or internet locations. This is for your convenience only. The fact that Sony provides a link to a website does not signify an endorsement, sponsorship, or affiliation with respect to such website, its owners or its providers. There are inherent risks in using, or retrieving any information found on the internet, and Sony urges you to make sure you understand these risks before going to a linked website. Sony shall not be held responsible for the information, products, or services obtained on such other websites and will not be liable for any damages arising from your access to such websites.
12. No Warranties.
a. YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE AND THE PROGRAM IS AT YOUR SOLE RISK. THE WEBSITE (AND ANY PORTION THEREOF), THE MOBILE APP, THE PROGRAM AND ANY SERVICES OFFERED IN CONNECTION WITH THE PROGRAM ARE PROVIDED “AS IS” “WITH ALL FAULTS” AND “AS AVAILABLE” BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. SONY AND ITS AFFILIATES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, SECURITY AND NON-INFRINGEMENT). To the extent that Sony may not, as a matter of applicable law, disclaim any implied warranty, the scope and duration of such warranty shall be the minimum permitted under such applicable law. Sony makes no warranties, guaranties or representations of any kind with respect to the Website/Mobile App or the Program.
b. Sony shall not be liable or responsible for any guarantee, warranty and/or representation offered by any Partners or third-party manufacturers. In the event that a third-party manufacturer or supplier offers its own warranties with respect to any Product made available through the Program, you agree to look solely to such manufacturer or supplier for any warranty related claims.
13. Limitation of Liability
a. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAWS, IN NO EVENT WILL SONY, ITS AFFILIATES, THE BANK, OR ANYONE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE PROGRAM, OR ANY OF THEIR OFFICERS, DIRECTORS, STOCKHOLDERS, EMPLOYEES, AGENTS OR OTHER THIRD-PARTY PROVIDERS BE HELD LIABLE TO YOU OR ANYONE ELSE UNDER ANY THEORY OF LIABILITY FOR ANY DAMAGES, LOSSES, LIABILITIES, OBLIGATIONS, OR COSTS, WHETHER DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL OR EXEMPLARY ARISING OUT OF, RESULTING FROM OR IN CONNECTION WITH ANY ASPECT OF THE PROGRAM, INCLUDING THE WEBSITE AND THE MOBILE APP, AND THE USE THEREOF (INCLUDING THE INABILITY TO USE OR THE DELAY THEREOF).
b. This limitation on liability includes, but is not limited to, and Sony and its affiliates are not responsible for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the Program; (iii) unauthorized access to or use of Sony’s servers and/or any and all personal information stored therein; (iv) interruption or cessation of transmission to or from the Website or Mobile App; (v) bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Website (or any parts thereof) or the Mobile App; (vi) loss or damage of any kind incurred as a result of the use by you or another Member of any content made available on or by means of the Website, the Mobile App, the Program and/or otherwise; (vii) defamatory, offensive, or illegal conduct of any Member or third party; and/ or (viii) failure, interruption or unavailability of mechanical or electronic equipment or network servers or communication lines, miscommunications, theft, operator errors, strike or other labor problems, incorrect or inaccurate bidding information, or any force majeure howsoever caused or other error of any kind whether human, mechanical or electronic. Sony cannot and does not guarantee continuous, uninterrupted or secure access to the Website/Mobile App.
c. You acknowledge and agree that Sony neither endorses nor shall be liable or responsible for the contents of any electronic mail, Internet communications, physical mail or other communications in any media, to the extent that Sony has not been the author and sender of such communications or mail.
a. You agree to release, indemnify and hold harmless Sony and its parent, subsidiaries, affiliates and their respective officers, directors, employees, agents, vendors, licensors, suppliers, third-party providers or other partners, from and against any and all claims, losses, costs (including court costs), fees (including attorney’s fees), damages and expenses that such parties may incur as a result of, due to, or arising out of: (i) the breach of any of the warranties, representations, covenants, responsibilities or other obligations set forth in this Agreement; (ii) your violation or alleged violation of any person’s intellectual property, privacy, publicity or other right; (iii) your use of any program offered by Sony or use and/or receipt of any benefit, award or product through the Program; (iv) the violation of any applicable laws and/or this Agreement by you and/or anyone using your Account to access and/ or otherwise use the Program; or (v) your willful misconduct or the willful misconduct of anyone accessing the Program through your Account, in connection with your (and/or such other person’s) use of the Program (in whole or in part).
b. Sony’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Sony reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Sony in asserting any available defenses. This Section 14 shall remain in full force and effect notwithstanding any termination of your use of the Program, including the Website/Mobile App.
a. Controlling Law; Lawsuits. This Agreement shall be governed by and construed according to the laws of the State of New York as applied to agreements made, entered into and performed entirely in New York. You agree that any disputes or legal proceedings arising out of or related to Program, the Website or the Mobile App, shall be brought in the state or federal courts in the State of New York, and shall be handled individually without any class action. You also agree that notwithstanding any statute or law to the contrary, any claim or cause of action arising out of, or related to, the use of the Program, the Website, the Mobile App or this Agreement must be filed within one (1) year after the claim or cause of action arose or be forever barred.
b. Court Orders and Subpoenas. Sony will comply with all court orders and subpoenas and cooperate with investigations by local, state and federal agencies. Under these circumstances, your Account information may be shared with others with or without such your knowledge or consent.
c. Complete Agreement/Invalidity & Severability. This Agreement constitutes the complete, final and exclusive understanding between Sony and each Member relating to the subject matter hereof and governs your use of the Program, including the Website and the Mobile App, superseding all prior or contemporaneous understandings, agreements, communications, and/ or advertising with respect to such subject matter. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, and all other provisions shall remain in full force and effect. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.
d. Third-Party Terms. Member may be subject to additional terms and conditions that may apply when Member obtains or uses third-party content, third-party software or goods and services provided by or through Partners or other third parties.
e. No Waiver. Sony’s failure to insist upon strict performance of any provision(s) of this Agreement or to exercise or enforce any
right or provision of this Agreement shall not constitute a waiver of its right or remedies or of the provision.
f. Assignment. Sony may assign its rights and delegate its duties under this Agreement to any party at any time without notice to you. The rights and licenses granted hereunder may not be assigned or transferred by you, and any attempted assignment or transfer in violation hereof shall be null and void.
g. Headings. All headings in this Agreement are for convenience only and have no legal effect.
h. Notice. Except as provided above with respect to modifications of this Agreement, Sony may deliver notices to Member by prepaid United States first class mail at the address in Sony’s database, or via electronic mail at the electronic mail address in Sony’s database; any such notice shall be deemed effectively given upon delivery. Member may give notice to Sony by prepaid certified mail, return receipt requested at the following address: Sony Rewards Program, 25 Madison Avenue, New York, New York 10010, Attn: Legal Department, and any such notice shall be effective upon receipt.
YOUR PARTICIPATION IN THE SHOWSTOPPERS PROGRAM (“SHOWSTOPPERS”) CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF SHOWSTOPPERS AS SET FORTH
HEREIN. ShowStoppers, which is brought to you by Sony, is a program in which Sony Rewards members can bid and redeem their Points for exciting adventures, experiences, goods and special offers (each referred to herein as a “Award”) through auctions (each an “Auction”) that will take place on the ShowStoppers portion of the Sony Rewards website and the ShowStoppers portion of the Mobile App (collectively, the “ShowStoppers Website/Mobile App”).
ShowStoppers is part of the Sony Rewards loyalty program, and participation in ShowStoppers is exclusively for Members who have a valid and open Sony Rewards account (“Account”) and the capacity to enter into legally binding agreements.
The terms and conditions (the “ShowStoppers Rules”) set forth herein apply to participation in ShowStoppers, and the use of the ShowStoppers Website/Mobile App. SUCH RULES ARE IN ADDITION TO, AND NOT A SUBSTITUTION FOR, THE TERMS AND CONDITIONS CONTAINED IN THE SONY REWARDS GENERAL MEMBER TERMS & CONDITIONS
INCLUDED HEREIN. In addition, an Auction
may have unique bidding instructions and rules, such as an age restriction, which will be outlined in the Award description. Although these rules refer to the term “Auction,” it is important to note that Sony is not an “auctioneer” in the traditional sense.
1. Access to and Acceptance and Use of the ShowStoppers Website
1.1. Acceptance of Terms and Conditions. By accessing the ShowStoppers section of the Website/Mobile App, making transactions through it, and specifically by clicking “BID NOW,” you expressly indicate your acknowledgment and acceptance of the ShowStoppers Rules. The information and Award descriptions published on the ShowStoppers Website may include inaccuracies or typographical errors, and Sony and its affiliates specifically disclaim any liability for such inaccuracies and errors. Sony, in its sole discretion, may amend, modify, correct, remove, change or supplement these ShowStoppers Rules and any other terms and conditions applicable to ShowStoppers, the ShowStoppers Website/Mobile App, any Award and/or any Auction, including, without limitation, to correct any typographical errors, and/or to change or amend an Award description or the opening bid price for an Award, and your continued participation will constitute your acceptance of any such amendment, modification or supplementation.
1.2. Acceptance of Electronic Communication. By participating in ShowStoppers, you hereby consent to receive electronic communications regarding Showstoppers, including the Auction process and different Awards from Sony and third-parties involved in ShowStoppers whether addressed to the email address associated with your Account or any other email address that you provide to Sony in connection with Showstoppers. You acknowledge and agree that any communication via email or postings on the ShowStoppers section of the Website/Mobile App satisfies any legal requirements that such communications be made in writing.
1.3. Use of the ShowStoppers Website. You may only use the ShowStoppers section of the Website/Mobile App to make non- commercial, legitimate Award purchases. You shall not use ShowStoppers or the ShowStoppers Website/Mobile App for any other purposes. You may not resell or barter any Award purchased through ShowStoppers. You also may not use any robot, spider, scraper or other automated means to access the ShowStoppers Website, including to bid on any Auction. Sony reserves the right to disqualify any ShowStoppers participant who tampers with or abuses any aspect of ShowStoppers, or who fails to comply with these ShowStoppers Rules. In addition, Sony reserves the right to seek all remedies available at law and in equity for any misuse of ShowStoppers, the ShowStoppers Website/Mobile App or any Awards and/or for any violations of these ShowStoppers Rules, including the right to block access from a particular internet address, to exclude any individual from accessing the ShowStoppers Website/Mobile App and/or to terminate an individual’s membership in the Sony Rewards loyalty program.
1.1 Award Descriptions. Through ShowStoppers, Sony allows you to bid for and purchase, in an auction-style format, Awards using Points. For each Award, the ShowStoppers Website/Mobile App will contain a complete description of the Award and any specific requirements for the Award’s Auction, including, without limitation, any minimum bid requirements, eligibility criteria, the date and time at which the Auction for the applicable Award will start and end, bid increments for the applicable Auction, which may depend on Award value, redemption restrictions (e.g. blackout dates), fees and taxes, shipping and handling costs, and all other applicable terms for the Award and the applicable Auction, all of which will be established by Sony. For certain Awards which are experiences, the Award winner must agree that Sony may take pictures and/or videos of the winner participating in the applicable Award experience, and may use, reproduce, copy, publish, distribute, modify and otherwise exploit such pictures and/or videos in any manner and in any media now known or hereafter devised, that it sees fit, without compensation to you. In addition, costs and expenses not specifically mentioned as being included as part of an Award are the sole responsibility of the Auction winner(s). Such costs and expenses may include, but are not limited to, travel insurance, room service, meals, unspecified ground transportation, gratuities, personal items and government fees. All Awards made available through ShowStoppers are being auctioned and sold “AS IS” without warranties of any kind, unless expressly stated in the Award description. All Awards, including the availability thereof, are subject to change, and if any Award becomes unavailable for any reason after an Auction’s end, Sony reserves the right, in its sole discretion, to substitute a substantially similar item or refund Points and if applicable, amounts paid for Points by the winning bidder(s). Such refund shall be your sole remedy in the event of Award unavailability. Awards will only be awarded and delivered to the winner(s) after the applicable bid amount has been paid and settled in accordance with Section 2.3.
1.2 Awards Provided by Unaffiliated Entities. Certain Awards may include goods, services and/or experiences that have been provided to Sony from unaffiliated third-parties. If an Award includes such goods, services or experiences, such information will be disclosed in the Award description. Inclusion of such items in ShowStoppers does not imply any endorsement, sponsorship or affiliation between Sony and such third-party, and Sony and its affiliates are not responsible for any goods, services and/or experiences of such third-parties. In addition, in certain instances Sony only provides the access and the technical platform for you to redeem an Award directly from a third- party. You acknowledge that in such circumstance’s separate terms and conditions of the relevant third-party may apply to the Award redemptions. You agree to abide by such terms and conditions, including but not limited to, rules and restrictions on availability, shipment and delivery terms, notification of defects and claims for damages. Neither Sony nor its affiliates become party to the transaction between you and the third-party.
1.3 Award Payment and Redemption. For each Award, you may purchase the Award for the amount of Points indicated on the ShowStoppers Website/Mobile App at the Auction’s close. In the event that you do not have enough Points in your Account at the time you bid on the Award, you may provide Sony with a valid credit card on which you may purchase the additional Points needed in the event that you are an Award winner, provided, however, that you must have at least the minimum number of Points indicated in the Award description in your Account at the time when you bid on an Award, provided, further, that for certain Auctions, you will not be permitted to purchase Points. In addition, all Points in your Account must be used to bid on the Auctions that you are bidding on prior to purchasing Points using a credit card. Points are purchased during the check-out process. In the event that you provide a credit card on which Points may be purchased, a hold will be placed on that credit card for the amount needed to purchase the required Points. (Points are purchased at $.01 per Point.) Such hold will continue until you are either outbid for the applicable Auction or you win the Auction, in which case your credit card will be charged for the purchase of the Points. In the event that you are the highest bidder for an Auction, or one of the highest bidders in the case of a Multi-Award Auction, the Points required for such Award will be deducted from your Account immediately upon completion of the Auction, and if applicable, as indicated above, your credit card will be immediately charged for the number of Points necessary to purchase, when combined with your existing Points, the Award. In the event that Sony cannot put a hold on your credit card, you will not be able to bid with Points to be purchased. You cannot bid with Points that are accrued, but are not yet credited to your Account at the time you bid on an Award. In the event that Points have not been properly debited from your Account upon completion of an Auction, Points can be debited by Sony at any time.
1.4 Shipping and Handling of Awards. Awards, and related Award documentation, including any special fulfillment instructions, will be sent, in Sony’s sole discretion, by email to the email address on your Account or an email address that you provide when you enter a bid, to the physical address associated with your Account or to such other address as explicitly provided for a specific Auction or Award. Delivery dates cannot be guaranteed and Sony and its affiliates assume no liability for failed deliveries caused by incorrect addresses, absence of the recipient, force majeure or other reasons not under the control of Sony. Award, and related Award documentation, can only be shipped to addresses in the United States, but cannot be delivered to P.O. or
A.P.O. boxes. If you want to ship to an address other than the address associated with your Account, please update the shipping
information during the online bid process. Addresses cannot be changed after an Award has been confirmed.
1.5 Refunds and Returns. All purchases made through ShowStoppers are final and except as indicated in these Rules, Points are not refundable once redeemed. Awards may not be returned or exchanged except in Sony’s sole discretion. In the event that an Award is damaged or defective upon initial delivery, Sony, in its sole discretion, reserves the right to replace the Award with a similar Award of equal or greater value or re-deposit the Points you used to bid on the Award into your Account, and if applicable, refund your credit card for Points purchased. In the event that Sony decides not to replace the Award with a similar Award, your sole remedy is a refund of Points used and if applicable, amounts paid for Points.
1.1 Minimum/Maximum Bids. Each Auction will have a minimum opening bid, which will be the least number of Points that you can bid on an Award, and minimum increments in which the bidding must increase. Auctions may also have a “Buy Now” bid price, the price at which you may immediately purchase the Award, or, if it is an Auction with multiple Awards, the number of Awards associated with the applicable Auction.
1.2 Eligibility. Certain auctions and at times the “Buy Now” feature may be available only to Sony Rewards Members who fit a certain criteria. For example, an auction may be available only to Members who hold a current outstanding Card in good standing. In such event, the rules for the applicable Auction will indicate this restriction. Sony has the right to define such criteria and can change the criteria upon its discretion.
1.3 Bidding. For each Award that you wish to bid on, you must go to the Award’s Auction page, and enter, where indicated, the maximum number of Points that you wish to bid, which is the highest price in Points you are willing to pay for the Award, whether through already accumulated Points or if permitted, accumulated Points and purchased Points as indicated in Section 2.3 of these Rules. You must then agree to abide by these Rules and click the “Bid Now” button. Once you confirm your bid it will be placed, and once placed, a bid cannot be cancelled or retracted, provided, however, that a bid is not considered “placed” until you see the Bid Confirmation If for any reason the bidding process is interrupted or the Bid Confirmation is not displayed, you must resubmit your bid.. If a bid is “placed” after an Auction’s bidding period has elapsed, such bid is not eligible. Decisions as to what constitutes a qualifying bid and when a bid is placed shall be determined by Sony, in its sole discretion. Once placed, ShowStoppers will store your maximum bid amount and will automatically place an initial bid on your behalf, to the extent that your bid is more than the then current winning bid. A bid will then be placed on your behalf only when it is needed to maintain your position as an Auction’s winning bidder, and is placed only up to your maximum bid amount. If you are the highest bidder but another Auction participant bids higher than your maximum bid, that bid will become the highest bidder and you will not win the Auction. You will be notified by email if have been outbid. (In the event that you are out-bid, you may increase your bid by placing a new higher bid.)
1.4 Multi-Award Auctions. A Multi-Award Auction is when more than one (1) of the same Award is listed for an Auction. In a Multi- Award Auction bidders may not bid on more than one (1) Award in the Auction. The winners of a Multi-Award Auction are those bidders with the highest bid amounts at the time of Auction close, up to the available quantity of Awards for the Auction. Each winner of a Multi-Award Auction will pay the amount that caused such person to be one of the highest bidders in such Multi-Award Auction, and thus, there is a possibility that not all winners of a Multi- Award Auction will pay the same amount for the Award.
1.5 Bidding on Multiple Auctions. You may not bid on multiple auctions. Specifically, you must have enough Points in your Account to fulfill your entire bid on one Auction prior to bidding on a second Auction, and so on. Once you use Points to bid on an Auction, a hold will be placed on such Points until you are outbid on the applicable Auction.
1.6 Winning Bid(s). The winner(s) of each Auction will be determined by Sony, or its designee, in its sole discretion based upon the highest bid (or highest bids in the case of a Multi-Award Auction) received prior to the final closing time of the applicable Auction. Should your bid be determined to be a winning bid, this will constitute a legally binding contract between you and Sony. For each Auction, the first name and last initial of the potential winner(s) of the Auction will be indicated on the ShowStoppers Website/ Mobile App. If you are a potential winner, you will receive notification of your potential winning bid via telephone, email or mail, as determined by Sony in its sole discretion. Such notification will contain Award details and any special fulfillment information. If you are a potential winner, immediately upon completion of the Auction the number of Points equal to the winning bid, and not your entire maximum bid if it is greater than the winning bid amount, will be deducted automatically from your Account. As indicated in Section 2.3, in the event that you do not have the necessary number of Points, your credit card will immediately be charged. Each Auction winner explicitly agrees that the number of Points invested in the respective Auction and such winner’s first name and the first initial of such winner’s last name can be displayed on the ShowStopper Website/Mobile App following the Auction. The winning bidder must comply with all terms and conditions of these ShowStoppers Rules and applicable to the relevant Award.
1.7 Ineligible Winner. A potential winner will only become an actual winner once Sony has verified such potential winner’s compliance with these ShowStoppers Rules. In the event that (i) Sony determines, in its sole discretion, that a potential winner was not eligible to participate in an Auction, (ii) a potential winner is expelled from participating in an Auction, or (iii) for any other reason a potential winner is disqualified from an Auction, Sony may make the decision to give the next highest bidder(s) the opportunity to be the winner of the Award, re-run the Auction or cancel the Award. In such event, the potential winner’s Points (and if applicable, amounts paid for Points) will be refunded.
Employees of Sony Electronics Inc. (“Sony”), its advertising or promotion agencies, those involved in the production, design, printing, development, implementation or handling of the Showstoppers, any agents acting for, or on behalf of the above entities, their respective parent, subsidiary, affiliated and related companies, officers, directors, licensees, service providers, any other person or entity associated with the applicable Showstopper (collectively “Showstopper Entities”), members of their immediate families (spouses, domestic partners, children, siblings, parents), and/or persons living in the same household as such persons, whether or not related, are ineligible to participate in the Showstoppers.
4. Winner’s Circle. The Sony Rewards Website/Mobile App contains a section called Winners Circle where content and pictures of the ShowStopper winners and their experience may be displayed. All content shall become the property of Sony subject to the ownership rights set forth in this Agreement, and such content is subject to the terms and conditions set forth in the Sony Rewards General Terms & Conditions, including but not limited to Section 6. Additionally, images used in to the Winner’s Circle must not (i) include materials (language, phrases, quotations, logo’s, etc.) belonging to or copyrighted by third parties, or (ii) contain or depict any objectionable, unlawful, defamatory, obscene, sexually-explicit, threatening, abusive, harassing, discriminatory, threatening, or vulgar material and must be otherwise fit for publication/posting/uploading, as determined by Sony, in its sole discretion. In addition, images must not contain the phone number(s), address, email address or other personally identifiable information of any person. MOVIES ANYWHERE and Movie Buff Pass: As a Sony Rewards Member (“Member”), you can earn Sony Rewards points (“Points”) for purchases of certain eligible DVD/Blu-ray disc movies (“Eligible Movies”) or by purchasing eligible digital movies through MOVIES ANYWHERE. In order to earn such points, as detailed below, you must register with MOVIES ANYWHERE, and then successfully link your Sony Rewards account to your MOVIES ANYWHERE account. After such registration and linking you can earn points by (i) entering the digital code found on the insert of such discs purchases on either the MOVIES ANYWHERE website (visit www.moviesanywhere.com/redeem) or the Sony Rewards mobile application, or (ii) as further detailed below, purchasing an Eligible Movie digitally through MOVIES ANYWHERE from a participating digital retailer, provided that such digital purchases must be made while logged into MOVIES ANYWHERE. A Member will be able to make a digital purchase while logged into a MOVIES ANYWHERE account by following the instructions on MOVIES ANYWHERE to link such “Member” account with a participating digital retailer, then completing an eligible digital transaction through such participating digital retailer, as instructed by such participating digital retailer. As indicated above, points are only awarded for purchases made after you successfully link your SONY REWARDS and MOVIES ANYWHERE accounts. In addition to earning Points, if, after you unlock the Movie Buff Pass, you register 5 Eligible Movies under the same Sony Rewards account within a 1 year time frame, you will be eligible for a free digital movie code, which will be awarded in the form of a MOVIES ANYWHERE free digital movie code (the “Code”). Once you have registered 5 Eligible Movies under the same Sony Rewards account within the 1 year time frame you will receive an email from Sony Rewards that contains the Code. You will need to click through that email and select your movie on the Sony Pictures redemption page, and then the Code will automatically populate when you are brought to the MOVIES ANYWHERE page. Members may only register a movie once. The Code entitles the recipient to select one (1) free digital movie from the Eligible Movies on the Sony Pictures redemption page. The Code must be redeemed within ninety (90) days of receipt of the applicable email from Sony Rewards containing the Code link. To complete your Code redemption, you must log into or create a MOVIES ANYWHERE account. Each Code is a limited one-time offer that is valid for single-time use only and cannot be combined with any other offers and is not redeemable for cash or credit. The Movie Buff Pass program can be modified or discontinued at any time by Sony Rewards. See email containing the Code link for additional details, terms and conditions. Kick Start Pass: As a Member, you can earn Points for completing all of the following activities when logged into Sony Rewards:
(1) complete your profile information; (2) complete your Preferences section by answering all questions about your personal interests; and (3) adding an item to your Wish List. Upon completion you will be awarded points. Members are only eligible for the Kick Start pass one (1) time. The Kick Start pass is subject to complete Sony Rewards Terms and Conditions, and is a limited time offer that can be modified or discontinued at any time by Sony Rewards. Once earned, it may take SR up to thirty
(30) business days to issue the Kick Start Pass and the related points.
Sony Rewards PlayStation Passes: Sony Rewards PlayStation Passes (“PS Passes”) are activity based promotions where Members who have linked their PlayStation Network account (“PSN”) to their Sony Rewards account can unlock various PS Passes and be rewarded by completing a defined set of activities. The defined set of activities and rewards offered by each PS Pass vary. The PS Passes are included below.
Trial Blazer Pass: As a Sony Rewards member, after you link your PSN account to your Sony Rewards account and unlock this Pass, you can earn the Pass by completing a trial of all three (3) PSN services through the PlayStation™Store, which include PlayStation™Now, PlayStation®Plus and Spotify® available on PlayStation™Music. For each Member, Sony will only award the Trial Blazer Pass one (1) time. As a result of being awarded with the Trial Blazer Pass, Sony will issue to you via email a 15% off coupon code for use at PlayStation™Store. Once you complete all three (3) trials, it may take Sony up to thirty (30) days to issue the Trial Blazer Pass and the related 15% off coupon code. Members must unlock this Pass via the Sony Rewards mobile app. The Trial Blazer Pass is subject to complete Sony Rewards Terms and Conditions, and is a limited time offer that can be modified or discontinued at any time by Sony.
Entertainment Trifecta Pass: As a Sony Rewards Member, after you link your PSN account to your Sony Rewards account and unlock this Pass, you can earn this Pass by subscribing to all three (3) PSN services through the PlayStation™Store, which include PlayStation™Now, PlayStation®Plus and Spotify® available on PlayStation™Music. You must keep the applicable paid PSN subscription for no less than 30 days in order for the subscription to count toward this Pass. Sony will award the this Pass after you have purchased three (3) PSN service subscriptions. (PSN subscriptions purchased prior to becoming a Sony Rewards Member and linking your PSN account to your Sony Rewards account will not count towards the Pass.) For each Member, Sony will only award the Entertainment Trifecta Pass one (1) time. The reward for completing this Pass is 500 Sony Rewards points. Once earned, it may take Sony up to thirty (30) business days to issue the Pass and the related points. Members must unlock this pass via the Sony Rewards mobile app. The Entertainment Trifecta Pass is subject to complete Sony Rewards Terms and Conditions, and is a limited time offer that can be modified or discontinued at any time by SR.
Triple Feature Pass: As an SR Member, after you link your PSN account to your SR account and unlock this Pass, you can earn the Pass by renting three (3) movies through the PlayStation™ Store. You may complete the Triple Feature Pass up to five (5) times per calendar year, which means renting a total of fifteen (15) movies through the PlayStation™ Store during such calendar year. The Triple Feature Pass will not be awarded retroactively. (Only movies rented after the date you unlock the Triple Feature Pass will count towards the reward of the Triple Feature Pass.) Members must unlock this pass via rewards.sony.com/ mobile-app. The reward for completing the Triple Feature Pass is 250 SR points. Once fulfilled, SR may take up to thirty (30) business days to award the Triple Feature Pass and to post the related points to your account. The Triple Feature Pass is subject to complete SR Terms and Conditions, and is a limited time offer that can be modified or discontinued at any time by SR.
Trophy Pass: The Trophy Pass program has been discontinued. Sony Rewards members will not be able to unlock a new Trophy Pass after October 29, 2018. For Sony Rewards members that unlocked a Trophy Pass prior to October 29, 2018, you may continue earning Points through the Trophy Pass program until November 7, 2019, at which time the program will be permanently discontinued for all Sony Rewards members.
Digital Trilogy Pass: As an SR Member, after you link your PSN account to your SR account, you can earn the Digital Trilogy
Pass by purchasing three (3) eligible Sony Pictures movies through the PlayStation™ Store. Only single movie title purchases of
$9.99 or more will be eligible as part of the Digital Trilogy Pass, provided that Sony movie bundles of $9.99 or more are eligible for consideration as one (1) “single movie title” and as such will count as one (1) purchase towards the Digital Trilogy Pass. (Eligible Sony Pictures movies purchased prior to linking your SR account to your PSN account will not count towards the Digital Trilogy Pass.) The reward for completing the Digital Trilogy Pass is 500 SR points. Once fulfilled, SR may take up to thirty (30) business days to award the Digital Trilogy Pass and post the related points to your SR Account. You do not need to unlock the Digital Trilogy Pass. It is automatically available to you once you link your SR account to your PSN account. The Digital Trilogy Pass, is subject to complete SR Terms and Conditions, and is a limited time offer that can be modified or discontinued at any time by SR.
Limited Time Promotional Passes: In addition to the passes indicated above, Sony may offer limited time Passes pursuant to which Members can earn Points (or other rewards, such as coupons) for completing certain defined sets of activities. The activities and rewards offered by each limited time Pass will vary. For example, the Pass may involve referring a friend to the Sony Rewards program, completing tasks in the Sony Rewards Mobile App, or completing certain tasks related to using your Sony Card. For each limited time Pass, Sony will set out the defined set of activities, any required timeframes, the rewards offered for completing such limited time Pass and any other material terms and conditions with respect to such limited time Pass in the promotional materials for the applicable Pass.
