Sony Rewards SuperFan Ratchet and Clank™ Trivia Sweepstakes Official Rules
No Purchase is necessary to enter or win.
1) Sweepstakes Period: The Sony Rewards SuperFan Ratchet and Clank™ Trivia Sweepstakes (the “Sweepstakes”) begins July 9, 2021 at 12:01 a.m. Eastern Time (“ET”) and ends July 30, 2021 at 11:59 p.m. ET (“Sweepstakes Period”).
2) Eligibility: This Sweepstakes is open only to permanent legal residents of the 50 United States and the District of Columbia, who are Sony Rewards Members and are at least 18 years of age (at least 19 years of age if a resident of Nebraska or Alabama; and at least 21 years of age if a resident of Mississippi) as of the date of entry. Employees of Sony Electronics Inc., Card Marketing and Services Company (the “Sponsor”), Don Jagoda Associates, Inc. (“Administrator”), their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively, the “Sponsor and its Administrators”), their affiliates and each of Sponsor’s and its Administrator’s respective employees, shareholders, directors, officers, members, assigns and agents and their immediate family members (collectively, the “Sweepstakes Entities”) and/or those living in the same household of each are not eligible to participate or win. Void where prohibited and subject to all federal, state and local laws.
3) How to Enter: During the Sweepstakes Period, you will receive one (1) entry into the Sweepstakes by visiting the Sony Rewards website at rewards.sony.com (the “Site”), registering to become a free Sony Rewards member, if you are not a member already, and thereafter, while you are signed into the Site, completing the Ratchet and Clank Trivia Quiz (the “Quiz Entry”). Quiz answers need not be correct to be eligible. You will receive the Sweepstakes entry for completing the Quiz. All Quiz Entries must be completed and received by 11:59 p.m. ET on July 30, 2021 to be eligible. To enter the Sweepstakes without completing the Ratchet and Clank Trivia Quiz and/or signing up as a Sony Rewards Member, you may enter via mail, by hand printing your name, complete address, date of birth and email address on a plain 3” x 5” card (a “Mail-In Entry,” and collectively with the Quiz Entries, the “Entries” and each an “Entry”). Mail your entry in a hand addressed envelope with sufficient postage affixed to: Sony Rewards SuperFan Ratchet and Clank™ Trivia Sweepstakes Entries, PO Box 7999 Melville, NY 11775-7999. All Mail-in Entries must be handwritten and must be postmarked by July 30, 2021 and received by August 6, 2021 to be eligible. Mechanically reproduced/photocopied Mail-In Entries are automatically void. Limit one (1) Entry per person, per email address, regardless of method of Entry. Any attempt by an entrant to obtain more than the stated number of Entries by using multiple/different email addresses, will void that entrant’s Sweepstakes Entry and that entrant may be disqualified, at Sponsor’s sole discretion. Normal Internet access, phone and usage charges imposed by your on-line or phone service may apply.
4) Random Drawing: There will be only one winner, the Grand Prize Winner (“Grand Prize Winner”), in this Sweepstakes. The Grand Prize Winner will be selected in a random drawing on or about August 14, 2021, from among all eligible Entries received during the Sweepstakes Period. Drawing will be conducted by Administrator, an independent judging organization whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning the prize depend on the number of eligible Entries received during the Sweepstakes Period. Subject to Section 6 below, the prize will be awarded and the potential Grand Prize Winner will be notified by e-mail.
5) Prize and Approximate Retail Value (“ARV”): Grand Prize (1): A Sony PS5 Console (ARV: $499.99) and a Ratchet & Clank: Rift Apart Standard Edition (ARV: $69.99). Total value of Prize is $568.98. Prize is awarded as is with no warranty or guaranty of any kind other than the standard Sony Electronics Inc. warranty. The ARV of the prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules, and the date the prize is awarded or redeemed. If the actual purchase price of the Grand Prize is less than the ARV stated herein, the prize winner will NOT be entitled to a check, cash or other form of payment for the price difference. Any depiction of the Grand Prize, in Sweepstakes materials or otherwise, is for illustrative purposes only. No substitution or transfer of the Grand Prize is permitted except at the sole discretion of the Sponsor who reserves the right to substitute the Grand Prize with a prize of equal or greater value. Any and all applicable federal, state and local taxes are the responsibility solely of the Grand Prize Winner.
6) General Rules: By participating in the Sweepstakes, all entrants agree to be bound by these Official Rules and the decisions of the Administrator and the Sponsor. The Grand Prize Winner will be required to execute and return an address verification form/eligibility confirmation via e-mail within 7 days of notification attempt, or prize will be forfeited and an alternate winner will be selected. If the potential Grand Prize Winner cannot be reached, does not respond within the time noted above, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her documents are undeliverable for any reason, such potential prize winner will be disqualified, and, in the Sponsor’s sole discretion, an alternate potential Grand Prize Winner may be selected from all remaining eligible Entries. Prize will be delivered within 6 to 8 weeks of winner confirmation. By accepting the Grand Prize, the Grand Prize Winner attests to the provisions stated herein including the accuracy of his/her personal information and his/her compliance with these Official Rules. The Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials or the offering or announcement of the prize. The Sponsor and its Administrators are not responsible for mistranscribed or faulty telephone communication, lost, late, illegible or postage-due Mail-In Entries or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of the Entries in this Sweepstakes. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant, meaning the email address associated with the winning Sony Rewards account. An “authorized account holder” of an email address is the natural person in whose name the email address has been issued by the Internet Access provider, or online service provider. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the drawing or Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and if it desires to award the Grand Prize from all eligible Entries received prior to cancellation.
The Sponsor, the Sweepstakes Entities, and each of their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or the Grand Prize awarded. Grand Prize Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or by use or redemption of the Grand Prize or by any related activities. Where permitted by law, acceptance of the Grand Prize constitutes permission for Sponsor and its affiliates to use the Grand Prize Winner’s name and likeness for promotional purposes without further compensation except where prohibited by law. By participating, entrants agree to release, discharge, indemnify and hold harmless Sweepstakes Entities, from any and all liability and any losses/injuries of any kind, resulting or arising from participation in this Sweepstakes or the acceptance/possession of the Grand Prize by the winner of such prize; or inability to use the prize; human error; incorrect or inaccurate transcription of any Sweepstakes entry information; any technical malfunctions of the telephone network, computer online system, computer equipment, software, or internet service provider utilized by this Sweepstakes or any entrant; interruption or inability to access this Sweepstakes, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant’s (or any third person’s) computer or mobile device and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed, mistranscribed, illegible or postage due Mail-in Entries, data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. In no event will Sponsor or any Sweepstakes Entity be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your participation in the Sweepstakes and the Grand Prize awarded hereunder. The failure of the Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, or actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations), pandemics or other force majeure event will not be considered a breach of these Official Rules.
7) Applicable Laws and Jurisdiction: This Sweepstakes is subject to these Official Rules and all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of New York. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by a state or federal court located in New York, NY. Each entrant further agrees that any claim/judgement/award shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes but in no event, attorney’s fees; and under no circumstances, will an entrant be entitled to awards. Should there be a conflict between the laws of the State of New York and any other laws, the conflict will be resolved in favor of the laws of the State of New York. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES WHETHER SOUNDING IN CONTRACT OR TORT.
8) Winner: For the name of the Grand Prize Winner, available after August 23, 2021, or an additional copy of the Official Rules by which all entrants are bound, send a stamped, self-addressed envelope by August 13, 2021, to: Sony Rewards SuperFan Ratchet and Clank™ Trivia Sweepstakes Winner or Rules, 25 Madison Avenue, New York, NY 10010.
